These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FoldJoy AI ("we," "us," or "our"). These Terms govern your access to and use of our mobile application, official website, and all related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please cease using the Service immediately.

We reserve the right to modify these Terms periodically. Material changes will be communicated via in-app notification. Your continued use after the effective date signifies acceptance of the revised Terms.

1 Age Requirements & Minors

If you have not reached the age of majority in your jurisdiction, you may only use the Service with the prior consent of a parent or legal guardian.

⚠️ Strict Prohibition: You shall not generate, upload, or distribute any sexualized, exploitative, or harmful content involving minors. If you are a parent or guardian and believe your child has provided personal data in violation of these Terms, please contact us immediately to request deletion.

2 Account & Registration

2.1 Certain features may be accessed without an account. However, we may assign a unique internal user ID for service stability; this ID does not identify you personally.
2.2 We may collect minimal device information (OS type, device identifier, IP address, app version, network type) solely to enable basic functionality. We never access your photo album without explicit authorization.
2.3 You are solely responsible for safeguarding your account credentials. Notify us immediately of any unauthorized access.
2.4 If using the Service on behalf of an organization, you represent that you have authority to bind the organization to these Terms.
2.5 Third-party login (Apple, Facebook, Google) is subject to the respective platform's terms. You are responsible for maintaining the confidentiality of your third-party login credentials.
2.6 All your activities within the Service are governed by these Terms and our Privacy Policy.

3 Core Service Functions

3.1 Editing & AI Generation

The app provides filters, fonts, stickers, templates, and AI-powered image/video generation tools.
Access to your photo album or files requires your explicit authorization; you may revoke it at any time via device settings.
You retain ownership of content you create. See Section 5 for licensing details.

3.2 Sharing & Distribution

If sharing content via third-party platforms, you must ensure you have full legal rights to the content and comply with applicable laws and the platform's terms.

4 Acceptable Use & Prohibited Conduct

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

4.1 General Requirements

You shall not engage in any unlawful activity, including violating laws of your jurisdiction or applicable international laws.
You shall not upload malicious code (viruses, Trojans), interfere with Service operation, or attempt unauthorized access to servers or databases.
You shall not abuse Service permissions (spam, fraud, circumventing app store rules, etc.).

4.2 Strictly Prohibited Content

You shall not create, upload, generate, or distribute any of the following:

(a) Content that is illegal, harassing, hateful, or sexually exploitative (especially involving minors);
(b) Content that unlawfully collects, uses, or discloses others' private information or violates their rights of publicity;
(c) Content that incites, lures, or assists illegal or criminal activity;
(d) Content that impersonates real persons or creates/distributes non-consensual intimate imagery;
(e) Content that infringes copyright, trademark, patent, or other intellectual property rights.

4.3 AI-Generated Content Disclaimer

All AI-generated content is automatically produced by algorithms. We do not endorse or guarantee its accuracy, completeness, or suitability. You are solely responsible for reviewing generated content for compliance before use, including respecting third-party rights (name, portrait, intellectual property).

4.4 Service Modifications

We reserve the right to update, iterate, adjust, suspend, or terminate any Service function. Where materially impactful, we will notify you in advance through reasonable channels.

5 Intellectual Property & User Content

5.1 All intellectual property rights in the Service (including software, designs, trademarks, and content) are exclusively owned by FoldJoy AI or our licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works without express permission.
5.2 Feedback you voluntarily submit may be used for product improvement without compensation to you.
5.3 You retain complete ownership of all content you create using the Service.
5.4 By uploading content, you grant us a non-exclusive, worldwide, royalty-free, revocable license limited to: providing the Service, function optimization, marketing promotion, and AI output generation.
5.5 Model Training: We do not use your User Content or generated content for model training or algorithm improvement without your prior express written consent. You may revoke consent at any time; revocation only affects future use.
5.6 For intellectual property infringement claims (DMCA, copyright, etc.), please submit a written notice to our contact email with proof of ownership and details of the infringing content.

6 Payments & Subscriptions

6.1 The app is free to download; basic features are free. Premium features may require a one-time in-app purchase via the Apple App Store.
6.2 All payments are exclusively processed by Apple Inc. You must comply with Apple's payment terms.
6.3 One-time purchases do not auto-renew. Feature unlock rules are described on the purchase page.
6.4 Refunds are solely handled by Apple per their official refund policy.
6.5 For payment issues, contact us or Apple directly.
6.6 Abuse of the Service or violation of these Terms may result in fees or compensation obligations as permitted by law.

7 Disclaimer & Limitation of Liability

7.1 "AS IS" Disclaimer: The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.

7.2 To the extent permitted by law, we are not liable for: indirect or consequential losses, commercial losses (lost profits, business interruption), or third-party losses arising from Service use.
7.3 Our total aggregate liability shall not exceed the total fees paid by you for relevant paid features (or the minimum limit prescribed by law if no payment was made).
7.4 Nothing in these Terms limits consumer rights that cannot be waived or restricted by applicable law.

8 Indemnification

You agree to indemnify, defend, and hold harmless FoldJoy AI, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

Your use of the Service;
Your violation of these Terms or applicable law;
Your User Content or any content you generate;
Your infringement of any third-party rights.

9 Governing Law & Dispute Resolution

9.1 Subject to mandatory consumer protection laws, these Terms are governed by and construed in accordance with the laws of Singapore.
9.2 Disputes shall be resolved by arbitration at the Singapore International Arbitration Centre (SIAC), unless applicable law permits court proceedings in your local jurisdiction.
9.3 If any provision is deemed invalid, the remaining provisions continue in full force and effect.

10 Miscellaneous

10.1 Service Updates: We may update the Service periodically. Some updates may be required for continued use; failure to install may limit functionality.
10.2 Service Availability: Interruptions may occur due to maintenance, upgrades, emergencies, or factors beyond our reasonable control.
10.3 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and FoldJoy AI regarding the Service.
10.4 Severability: If any provision is unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall remain in effect.
